1. Plaintiff brings this action pursuant to S.C. Code Ann. §15-61-10, et seq., and jurisdiction and venue are proper in Richland County, where the subject property is located.
2. Albertha H. Simons died intestate on January 1, 1972, owning real property located at 1104 House Street, Columbia, SC 29204 (“Property”) having been so conveyed by deed recorded in the Office of the Register of Deeds for Richland County in Deed Book D292 at page 23.
3. The Plaintiff is the duly appointed Personal Representative of the Estate of Robert L. Simons, having been appointed by the Judge of the Richland County Probate Court on April 22, 2025.
4. At her death, Albertha H. Simons was survived by her husband, Robert L. Simons, and by her siblings, Susie Robinson, Mollie Brown, Jennie Williams, Ruth Taylor, Mac Duncan, Russell Harrison, Ernest Harrison, and Benjamin Harrison, and the children of deceased siblings, Mabel Mabry, Corrine Risdon, Florrie Harrison, and Pearl Cummings.
5. Ernest Harrison died intestate during April 1974 leaving two children Vivian Stroman and Alton Harrison.
6. Robert L. Simons died on June 15, 1974. By his duly probated Last Will and Testament, he appointed I. S. Leevy Johnson as Executor (now known as Personal Representative) with authority to sell real property of his estate.
7. Susie Robinson died intestate during 1976, leaving no spouse or issue.
8. Russell Harrison died during 1976, survived by his spouse, Louise Harrison and their daughter, Alma Hart.
9. Benjamin Harrison died testate in 1978. By the terms of his will, his interest was devised to his sisters, Mae Duncan, Jennie Williams and Ruth Taylor.
10. By description of real estate dated July 19, 1974, Robert L. Simons one- half (1/2) interest was conveyed to I.S. Leevy Johnson, Executor.
11. Since 1974, Plaintiff I. S. Leevy Johnson, in his fiduciary capacity, has paid all property taxes without contribution from other heirs.
12. On April 22, 2025, the Richland County Probate Court re-opened the Estate of Robert L. Simons for the limited purpose of selling the subject Property, and issued Letters of Appointment to Plaintiff as Personal Representative.

Petitioner comes before this Court seeking approval of a compromise settlement in a claim for damages arising out of injuries and the resulting death of Richard Dillon Earl Smith. (Approval of a
Compromise
Settlement) Death Statute, set forth in § 15-51-10 et seq., S.C. Code Ann. (1976), and that an action for damages recoverable for death by wrongful act may be brought by her as Personal Representative for the Estate of Richard Dillon Earl Smith, deceased, for the benefit of Lori Bradley James, as the surviving heir. Petitioner is not aware of any claims or creditors of the Estate of Richard Dillon Earl Smith. Petitioner has retained the services of Jordan F. Guthrie and Savanna Kimble Earles of King Law Offices, P.C. who has investigated the facts surrounding the death of the deceased together with the applicable law, and after a full investigation, counsel for Petitioner has made settlement demands upon South Carolina Farm Bureau Insurance Company and has negotiated with South Carolina Farm Bureau Insurance Company. Petitioner’s counsel has reached a compromise settlement for the damages pursuant to the South Carolina Wrongful Death Statute (§ 15-51-10, et seq., of the 1976 Code, as amended), arising out of the injuries and death of Richard Dillon Earl Smith. Subject to the approval of the Court South Carolina Farm Bureau Insurance Company has agreed to pay the total sum of One Hundred Thousand and 00/100 ($100,000.00) Dollars, of which One Hundred Thousand and 00/100 ($100,000.00) Dollars shall all be allocated to the Wrongful Death Action. It is recognized that as part of the settlement, South Carolina Farm Bureau Insurance Company is paying One Hundred Thousand and 00/100 ($100,000.00) Dollars, which is the full limits of the bodily injury liability coverage to Lori Bradley James as Personal Representative for the Estate of Richard Dillon Earl Smith, deceased. Petitioner has carefully considered the settlement recommended by her counsel and is satisfied from all the facts and circumstances that the acceptance of said offer will be to the best interest of herself, pursuant to South Carolina law. Inheritance) The decedent’s statutory heirs pursuant to S.C. Code § 62-2-103(2) are his biological parents, including the Petitioner and Thomas Kerr, the decedent’s biological father. An estate has been opened for the decedent in this Court under the abovecaptioned case number, and Petitioner was appointed as Personal Representative by Order of this Court dated July 10, 2024. Petitioner files this petition pursuant to S.C. Code § 62-2-114, which provides that the probate court may deny or limit a parent’s inheritance if it finds, by a preponderance of the evidence, that the parent failed to reasonably provide support for the decedent as defined in S.C. Code § 63-5-20 and did not otherwise provide for the needs of the decedent during his minority. Thomas Kerr, the decedent’s biological father, failed to provide reasonable support or any other provision for the needs of the decedent during his lifetime. Mr. Kerr had no relationship with the decedent, was not involved in his upbringing, and did not contribute financially or emotionally to the decedent’s care or well-being during his minority. Petitioner further requests that this Court find Thomas Kerr to be a disqualified parent pursuant to S.C. Code § 62-2-114. Upon such a finding, Petitioner asserts that she is the sole remaining statutory heir of the decedent, and therefore the sole person entitled to inherit from the decedent’s estate and to receive the proceeds of any settlement or distribution.
