JURISDICTION AND
VENUE Defendant Dax Lewis and Doren Lewis are persons who resided and can be served at 1141 Allen Street, Cayce, South Carolina 29033. Jurisdiction is proper in this court Venue is proper in this court.
FACTUAL
ALLEGATIONS Defendants, Dax Lewis and Doren Lewis assisted Defendant Sonja L. Lewis hurried move of her mother and the Plaintiffs mother, Mrs. Carrie Bell Muller Lewis from 1141 Allen Street, Cayce, South Carolina 29033 to 605 Morning Drive College Park, GA 30349. The move was done without the knowledge or consent of the Plaintiff. The plaintiff and his son had to sue to be able to see Mrs. Carrie Bell Muller Lewis. Defendant Sonja L. Lewis is the mother of Dax Lewis and Doren Lewis. Defendant Dax Lewis and Doren Lewis worked alongside Defendant Sonja L. Lewis at all times and supported all her efforts toward Plaintiff’s mother Mrs. Carrie Bell Muller Lewis. Defendant Sonja L. Lewis has had Plaintiff’s mother, Mrs. Carrie Bel Muller Lewis medical power of attorney since 2009 crafted and notarized by Attorney Elnora Dean’s office. Plaintiff, asked Defendant Sonja L. Lewis to produce all medical records from January 2015 to her date of death, May 13, 2021. This included all doctors’ appointments and reports, all examinations, and a list of all medicines and treatments in South Carolina and Georgia and receipts. Plaintiff request list of all bank accounts and all changes to the bank accounts from January, 2015 to the present day. This includes, Wel Fargo Bank, First Citizen Bank, Synovus Bank, Lexington State Bank, Richland Memorial Hospital Credit Union and any account not mentioned.
2. Defendants, Dax Lewis and Doren Lewis assisted or had knowledge Defendant Sonja L. Lewis misuse of Mrs. Carrie Bell Muller Lewis’ social security and retirement for 40 months until the time the court ordered the appointment of a conservator. Defendant Sonja L. Lewis also emptied the bank account of Well Fargo Bank, First Citizen Bank, Synovus Bank, Lexington State Bank, Richland Memorial Hospital Credit Union, plus misusing a $5,000.00 Cincinnati Life insurance policy and $3000.00 Support fund from Isaac Smith, Jr. The account was turned back over to the Defendant Sonja L. Lewis at death of Mrs. Carrie Bell-Muller Lewis. Plaintiff never received any accounting of the funds. At all times the of the Defendant Sonja L. Lewis unethical and illegal activity.
3. Defendants, Dax Lewis and Doren Lewis assisted or had knowledge of the Defendant Sonja L. Lewis unethical and illegal activity. Defendant Sonja L. Lewis stated in a Fulton County Georgia Probate Court hearing that her attorney, Elnora Dean told her that she did not have to keep any records of how she spent Mrs. Carrie Bell Muller Lewis’ money. Defendant Sonja L. Lewis has no receipts for the thousands of dollars she spent of Mrs. Carrie Bel Muller Lewis’ money. After twenty (20) months the Conservator, Anna Herrera gave Defendant Sonja L. Lewis the First Citizens Bank Accounts of Mrs. Carrie Bell Muller Lewis.
4. Defendants, Dax Lewis and Doren Lewis assisted or had knowledge of the Defendant Sonja L. Lewis unethical and illegal activity. Defendant Sonja L. Lewis hired Attorney Elnora Dean who engaged in unethical legal practices. Attorney Dean engaged in several unethical legal practices as it related to my mother. She testified under oath in Richland County Probate Court that she represented my mother while at the same admitting that she did not know whether Mrs. Carrie Bel Muller Lewis was competent and had the capacity to make decisions. She has never been authorized to represent Mrs. Carrie Bell Muller Lewis in Richland County Probate Court, yet Defendant Sonja L. Lewis listed her as the attorney for Mrs. Carrie Bell Muller Lewis when Sonja L. Lewis was not authorized to do so. Attorney Dean with my sister, the Defendant Sonja L. Lewis testified under oath that she represented my mother while at the same admitting that she did not know whether Mrs. Carrie Bell Muller Lewis was competent and had the capacity to make decisions. At all times the
5. Attorney Elnora Dean has exercised unethical behavior throughout her proposed representation of my mother. Defendants, Dax Lewis and Doren Lewis assisted or had knowledge of the Defendant Sonja L. Lewis unethical and illegal activity and they and Sonja L. Lewis hired Attorney Elnora Dean to oversee a transaction where my mother conveyed her property when she acknowledged Mrs. Carrie Bel Muller Lewis conveyed her legal title to Defendant Sonja L. Lewis when Defendant Sonja L. Lewis knew Mrs. Carrie Bell Muller Lewis lacked capacity to do so. Therefore, I am asking the court to instruct Attorney Elnora Dean to produce copies of all works relating to Mrs. Carrie Bell Muller Lewis. Furthermore, I ask the court to instruct Attorney Elnora Dean to be available at any court proceeding to give testimony.
6. To further show the disingenuousness of Defendants, Dax Lewis and Doren Lewis assisted or had knowledge of the Defendant Sonja L. Lewis unethical and illegal activity, they along Defendant Sonja L. Lewis, they and their attorney, Elnora Dean, they filed Guardianship and Conservatorship papers in the Lexington County South Carolina Probate Court stating that Mrs. Carrie Bell Muller Lewis suffered from Dementia and that she was not competent in September, 2016, yet in October 2016 Defendant Sonja L. Lewis executed and Elnora Dean filed a document in the Lexington Register of Deeds Office giving a Durable Power of Attorney to Defendant, Sonja L. Lewis. All paperwork was notarized in Attorney Elnora Dean’s Office. Documents show Mrs. Care Bell Muller Lewis overworked signature. At all times the
7. Defendants, Dax Lewis and Doren Lewis assisted the Defendant Sonja I. Lewis unethical and illegal activity. Plaintiff and his son were not included in the planning of Mrs. Carrie Bell Muller Lewis’ funeral. Mrs. Carrie Bell Muller Lewis died Thursday after Mother’s Day. Mrs. Carrie Bell Muller Lewis died on May 13, 2021. On Mother’s Day and the previous three (3) Mother’s Day, the Plaintiff and his son tried in vain to reach Defendant, Sonja L. Lewis so that they could visit, get information on how she was doing or get any information on Mrs. Carrie Bell Muller Lewis. The Plaintiff and his son were not a part of Plaintiffs mothers send off. These circumstances represent intentional infliction of emotional distress. At all times the

FIDUCIARY DUTY Defendants, Sonja L. Lewis and her children Dax Lewis and Doren Lewis had knowledge of the Defendants bad a legal duty to provide adequate care to Mrs. Carrie Bell Muller Lewis, involuntarily in her custody, provide adequate supervision of her the Plaintiff mother’s finances.

NEGLIGENCE PRO SE Defendants, Sonja L. Lewis and her children Dax Lewis and Doren Lewis had a legal duty to provide adequate care to Mrs. Carrie Bel Muller Lewis, involuntarily in her custody, provide adequate supervision of her the Plaintiffs mother’s finances.

NEGLIGENCE Defendants, Sonja L. Lewis and her children Dax Lewis and Doren Lewis had duty to the Plaintiff to take care of his mother, Mrs. Carrie Bell Muller Lewis, who was in the Defendant Sonja L. Lewis custody without the Plaintiff’s consent or knowledge

FRAUD Defendant Sonja L. Lewis and her children Dax Lewis and Doren Lewis misused Mrs. Carrie Bell Muller Lewis’ social security, retirement, bank accounts of Wells Fargo Bank, First Citizen Bank, Synovus Bank, Lexington State Bank, Richland Memorial Hospital Credit Union, for 40 months until the time the court ordered the appointment of a conservator, a $5,000.00 Cincinnati Life insurance policy and $3000.00 Support fund from Isaac Smith, Jr. was a willful defrauding of Mrs. Carrie Bell Muller Lewis, the Plaintiff, Isaac Smith, Jr. and his son who never received any accounting of the funds.

INTENTIONAL
INFLICTION OF
EMOTION DISTRESS Defendant Sonja L. Lewis and Defendants, Dax Lewis and Doren Lewis and refusal to include the Plaintiff and his son in the planning of Mrs. Carrie Bell Muller Lewis’ funeral along with not letting the Plaintiff see, his mother, Mrs. Carrie Bell Muller Lewis and forcing the Plaintiff and his son to sue to find out the whereabouts of Mrs. Carrie Bell Muller Lewis was intentional infliction of emotion distress. These circumstances represent intentional infliction of emotional distress. WHEREFORE, the Plainliff is entitled to damages from the Defendant Sonja L. Lewis, Dax Lewis and Doren Lewis and he does hereby pray that judgment be entered in his favor and against the Defendant Sonja L. Lewis as follows:
1. Misuse and misappropriation of Mrs. Carrie Bell Muller Lewis social security, retirement, bank accounts of Well Fargo Bank, First Citizen Bank, Synovus Bank, Lexington State Bank, Richland Memorial Hospital Credit Union, for 40 months until the time the court ordered the appointment of a conservator, a $5,000.00 Cincinnati Life insurance policy and $3000.00 Support fund from Isaac Smith, Jr. in the amount of $180,000.00; plus
2. Intentional infliction of Emotional distress and humiliation suffered by Plaintiff, Isaac Smith, Jr. and his son, Broderick Smith in the amount of $100,000.00; plus
3. Plaintiff further is entitled and do hereby seek recovery of all costs and attorney’s fees incurred by Plaintiff in this civil action, together with for such further and additional relief at law or in equity that this Court may deem appropriate or proper. In addition to the monetary damages sought, the court Plaintiff is asking the Court to consider charges of elder abuse, grand theft, and fraud against Defendant Sonja L. Lewis, children Dax Lewis and Doren Lewis and any other possible charges against them. The pain that the Defendant Sonja L. Lewis and her children Dax Lewis and Doren Lewis has inflicted on my mother, Mrs. Carrie Bell Muller Lewis, my son and myself deserves jail time for her. It must have appeared to my mother, Mrs. Carrie Bell Muller Lewis that her son had abandoned her. This is unacceptable consciousness. My sister, the Defendant, Sonja L. and her children Dax Lewis and Doren Lewis must be held accountable for her evil and destructive actions toward my mother, Mrs. Carrie Bell Muller Lewis, my son and myself. TO THE DEFENDANT(S) ABOVE NAMED: YOU ARE HEREBY SUMMONED and required to appear and defend by answering the Complaint in this action, a copy of which is hereby served upon you, and to serve a copy of your Answer on the subscribers at their offices at 3800 Fernandina Road, Suite 110, Columbia, SC 29210, within thirty (30) days after the service hereof, exclusive of the day of such service; except that the United States of America, if named, shall have sixty (60) days to answer after the service hereof, exclusive of the day of such service; and if you fail to do so, judgment by default will be rendered against you for the relief demanded in the Complaint. YOU WILL ALSO TAKE NOTICE that Plaintiff will move for an Order of Reference or the Court may issue a general Order of Reference of this action to a Master-in- Equity/Special Referee, pursuant to Rule 53 of the South Carolina Rules of Civil Procedure. YOU WILL ALSO TAKE NOTICE that under the provisions of S.C. Code Ann. § 29-3-100, effective June 16, 1993, any collateral assignment of rents contained in the referenced Mortgage is perfected and Attorney for Plaintiff hereby gives notice that all rents shall be payable directly to it by delivery to its undersigned attorneys from the date of default. In the alternative, Plaintiff will move before a judge of this Circuit on the 10th day after service hereof, or as soon thereafter as counsel may be heard, for an Order enforcing the assignment of rents, if any, and compelling payment of all rents covered by such assignment directly to the Plaintiff, which motion is to be based upon the original Note and Mortgage herein and the Complaint attached hereto.
