Adams, Richland County Treasurer, to Pensco Trust FBO Rhonda Meisner by a tax deed dated March 28, 2008, recorded March 28, 2008, in the Richland County Register of Deeds Office in Book R 1415 at page 1557.

5. The defendant, Jacob Anderson, was the owner of record of the Property at the time of Tax Sale #1 on December 4, 2006.

6. On or about November 17, 2014, David A. Adams, Richland County Treasurer/ Tax Collector, sold the Property at tax sale (Tax Sale # 2) to Jennifer B. Gardner, who was the highest bidder, and the Property was conveyed by David A. Adams, Richland County Treasurer, to Jennifer B. Gardner by a tax deed dated March 7, 2016, recorded March 14, 2016, in the Richland County Register of deeds Office in Book R 2095 at page 776.

7. The Property was subsequently conveyed by Jennifer B. Gardner to Jennifer Butler Gardner and Leonard R. Gardner, III, as co-Trustees of the Jennifer Butler Gardner Trust under Agreement Dated July 08, 2016, by a deed dated September 11, 2016, recorded December 12, 2016, in the Richland County Register of Deeds Office in Book R 2171 at page 1700.

8. The plaintiff, Leonard R. Gardner, as Trustee of the Jennifer Butler Gardner Trust under Agreement Dated July 08, 2016, is bringing this action pursuant to S.C. Code Sections 12- 61-10 through 12-61-60 to clear title to the Property and bar all other claims to the Property.

Code Ann. § 29-3-100, effective June 16, 1993, any collateral assignment of rents contained in the referenced Mortgage is perfected and Attorney for Plaintiff hereby gives notice that all rents shall be payable directly to it by delivery to its undersigned attorneys from the date of default. In the alternative, Plaintiff will move before a judge of this Circuit on the 10th day after service hereof, or as soon thereafter as counsel may be heard, for an Order enforcing the assignment of rents, if any, and compelling payment of all rents covered by such assignment directly to the Plaintiff, which motion is to be based upon the original Note and Mortgage herein and the Complaint attached hereto.
