The portion of State Road S-40-1098 sought to be abandoned is that portion of the road located on the western side of Spears Creek Church Road and beginning from its western terminus into an unnamed Richland County public right- of- way serving as an access drive for those certain parcels of real property commonly referred to as (i) 4681 Percival, Richland County Tax Map# R28800-06-02 & ( ii) Richland County Tax Map# R28800-06-03, and running in an easterly direction for approximately 1,150’ (+/-), ending at its eastern terminus into that certain parcel of real property bearing Richland County Tax Map Number R28800-05-02, and currently owned by Spears Creek Storage, LLC. LIS PENDENS NOTICE IS HEREBY GIVEN that an action has been or will be commenced in the Court of Common Pleas for Richland County upon a Complaint of the above- named Plaintiff against the above-named Defendants seeking to establish, by adverse possession, title in the Plaintiff to the servient estate as described herein, or, alternatively, to establish an easement in favor of the Dominant Estate, which is owned by the Plaintiff, over the Servient Estate, for access, ingress and egress to and from the Dominant Estate to Kay Street, and for other purposes promoting the general use and enjoyment of the Dominant Estate, such easement being obtained by prescription and implied by plat. The Dominant and Servient Estates covered and effected by this declaratory judgment action are described below. The Dominant Estate is described as follows: All that certain piece, parcel or tract of land, situate, lying and being near the eastern side of Kay Street, in the County of Richland, State of South Carolina, containing 9.38 acres, more or less, as detailed on a plat thereof entitled " Colony East Apartments" made by Albert A.
