PETITION TO

PURCHASE REAL

ESTATE IN THE MATTER OF: Albert Meriweather Gross, Jr. The Petitioners, by their Petition, would should:

1. Heretofore via a deed recorded on July 25, 1977, in Newberry County, a copy of which is attached hereto, Jim Byrum ( Byrum), Nic Church (Church), and Albert M. Gross (Gross) purchased certain real property in Newberry County known as 22.82 acres as shown on a plat dated July 7-12, 1977, as recorded in Newberry County in Plat Book AP at Page 184. Thereafter, Jerry Paul (Paul) purchased from the Grantees a one- fourth (1/4) interest therein on June 30, 1978.

2. Gross is now deceased, having died testate with his Estate being probated in Richland County as 1999-ES-40-00735. Kellie Ruocco ( Ruocco) is the Personal Representative of the Estate. The Last Will and Testament of Gross grants unto the Personal Representative the authority to sell the Estate's assets. Under the terms of the Will, Ruocco, Albert M. Gross, III ( Gross, III), Heather Gross Sansbury ( Sansbury), and Hannah L. Gross Edelhoch ( Edelhoch) share equally in the subject real property.

3. Gross, III, conveyed unto Lee N. Bozard (Bozard) a one-half (1/2) interest of his one-fourth ( 1/ 4) interest in accordance with a deed recorded in Newberry County on March 4, 2008, in Book 01375 at Page 179. However, a Deed of Distribution was never authorized by the Court or executed by the Personal Representative. Any conveyance by Gross, III, to Bozard is subject to the closing of the Estate and the payment of all creditor claims.

4. The Estate wishes to sell and Petitioners desire to purchase the Estate's interest in the 22.82 acres as herein described for the sum of $120,000.

5. That the Petitioners are informed and believe that they shall be permitted to purchase the Estate's interest and to pay the process to the Personal Representative of the Estate, with any disbursement of said funds being approved by the Court.

6. That upon the Court's approval of the sale of the Estate's interest in said property and the payment of the $120,000, all interest of the Estate, its heirs, creditors, and Grantees shall be forever terminated and ended, and any Orders heretofore rendered with regard to this property be deemed null and void. WHEREFORE, the Petitioners pray that the Court authorize the Personal Representative of the Estate of Albert Meriweather Gross, Jr., to sell the 22.82 acres of property located in Newberry County for the sum of $ 120,000, being paid to the Personal Representative and disbursed in accordance with the Order of the Court.
