1. Upon information and belief, the Defendant is a resident of the County of Richland, State of South Carolina and the subject of this action is real property located in the County of Richland, South Carolina.

4. The herein described property is subject to a Declaration of Covenants, Conditions, Restrictions and Easements for Avebury made by Palmetto Traditional Homes, LLC on December 3, 2001. By virtue of this Declaration, the Defendant by taking possession of the property, agreed to pay assessments, as follows:

1. Except as set forth elsewhere in the Declaration, Declarant covenants and each Owner of any Lot, whether or not it shall be so expressed in any such deed or other conveyance, shall be deemed to covenant and agree to all the terms and provisions of this Declaration and to pay to the Association: (1) regular annual assessments or charges; and (2) special assessments or charges for the purposes set forth in this Article. Regular annual assessments and special assessments are to be fixed, established and collected from time to time as hereinafter provided. Regular annual assessments and special assessments are to be fixed, established and collected from time to time as hereinafter provided. The regular annual assessments and special assessments together with such interest thereon and costs of collection therefore, as hereinafter provided, shall be a charge and continuing lien on the Lot and Patio Home thereon against which each such assessment is made. Each such assessment, together with assessed interest thereon and all costs of collection, as hereinafter provided, shall also be the personal obligation of the Owner of such Lot at the time when the assessment first becomes due and payable.... 5. Pursuant to the Declaration of Covenants, Conditions, Restrictions and Easements for Avebury, the Plaintiff is entitled to foreclose on the afore-mentioned lien. If the regular annual assessment or any special assessment is not paid by an Owner on or before its past-due date, then such assessment shall become delinquent, shall bear interest from the past due date until paid at the rate of the lesser or (i) sixteen percent (16%) per annum...and shall automatically and immediately (together with interest thereon as provided herein and all costs of collection, including attorney's

If the assessment is not paid within thirty (30) days after the past-due date, the Association may, at its election, bring an action to foreclose its lien on the property or bring an action at law against the Owner personally. If a delinquent assessment is put in the hands of an attorney-at-law for collection, there shall be added to the amount of such assessment all costs of collection, including, but not limited to, sixteen percent (16%) of the amount of the delinquent assessment and all interest thereon as reasonable attorney's fees. 6. The Defendant has failed to make consistent payments of the assessments and interest, although demand for payment has been made, and the Plaintiff after giving all required notices, has and does hereby elect to declare the entire balance payable at once. There is now due, owing and unpaid the sum of $1,588.78 together with reasonable attorney's fees and the cost of litigating this proceeding.

7. Heretofore, on or about August 22, 2008, Plaintiff filed a Notice of Lien in connection with unpaid assessments on the herein referenced property owned by the Defendant. 8. If Plaintiff secures the premises being foreclosed herein, Plaintiff's cost of securing said premises should be added to any judgment rendered on its behalf. If Plaintiff pays any utility charges constituting a lien on said premises, Plaintiff's advances should be added to any judgment rendered on its behalf. WHEREFORE, having fully set forth its Complaint, Plaintiff prays that this Honorable Court inquire into the matters as set forth herein:

1 Under the direction of this Court, ascertain and determine the amount due as outlined by the Declaration of Covenants, Conditions, Restrictions and Easements for Avebury held by the Plaintiff, together with interest of 16% Per annum and reasonable attorney's fees and costs as outlined in the Declaration of Covenants, Conditions, Restrictions and Easements for Avebury.

2 That said Plaintiff have judgment of foreclosure for the amount so found to be due and owing thereon, together with any taxes or insurance premiums which may be due, with a reasonable sum as attorney's fees, and for the costs of this proceeding.

3 That the premises be sold under the direction of this Court, the equity of redemption be barred, and that the proceeds of sale be applied as follows:

a. First, to the costs and expenses of the within proceeding and said sale;

b. Second, to the payment and discharge of the amount due under Declaration of Covenants, Conditions, Restrictions and Easements for Avebury, together with attorney's fees as aforesaid; and

c. Third, the surplus, if any, be distributed pursuant to Rule 71, of the South Carolina Rules of Civil Procedure.
