AND CONSENT The plaintiff would respectfully show unto the court: This is an action for the foreclosure of a real estate mortgage. Petitioner has been informed Johnnie Rutherford and Roberta Rutherford are deceased. Plaintiff is without sufficient knowledge or information to determine whether any defendants, known or unknown, are in the military service of the United States of America, thereby being entitled to the benefits of the Servicemembers Civil Relief Act of 2003, as amended. Robert C. FitzSimons, a member of the South Carolina Bar, is fully competent to protect the interests and rights of any defendant, known or unknown, who may be in the military service and that he has no interest in the real estate being foreclosed or any interest adverse to that of the defendants.
