COMPLAINT The Plaintiff, complaining of the Defendant above-named, would respectfully show unto this Honorable Court that:
1. The Plaintiff is a citizen and resident of the County of Horry, State of South Carolina
2. Upon information and belief, the Defendant is an illegal immigrant whose last known address is in the County of Lexington, South Carolina.
3. On or about November 23, 2005, the Plaintiff was traveling west on U.S. 76 in Richland County, South Carolina, when the Defendant, traveling east on U.S. 76, failed to yield and turned left across traffic into oncoming traffic, striking Plaintiff=s vehicle.
4. As a result of the collision, Plaintiff sustained injuries and damages.
5. As a result of the collision, Plaintiff suffered the following injuries and damages, to wit:
a. extensive pain, mental anguish, suffering and discomfort;
b. disability for a period of time, past and future;
c. money spent for medical care and treatment, past, and future;
d. inability to carry on normal activities;
e. permanent injuries, and partial disability;
f. emotional trauma and distress;
g. loss of enjoyment of life; and
h. time and wages lost from her job.
6. The injuries and damages incurred by the Plaintiff were directly and proximately caused by the Defendants careless, negligent, grossly negligent, willful, wanton, reckless, and unlawful acts in one or more of the following particulars:
a. in failing to apply the brakes of the vehicle and/or maintain them in proper working condition;
b. in failing to steer or take other evasive action so as to avoid the collision;
c. in failing to keep a proper lookout;
d. in failing to yield as required by law;
e. in disregarding a legal traffic marker;
f. in operating a vehicle too fast conditions;
g. in failing to maintain control of the vehicle;
h. in failing to observe the condition of traffic; and
i. In failing to exercise that due care as required by law.
7. The Defendant=s careless, negligent, grossly negligent, willful, wanton, reckless and unlawful acts were the direct and proximate cause of the collision and resulting injuries and damages to Plaintiff.
8. The Plaintiff is informed and believes that she is entitled to judgment against the Defendant for actual and punitive damages in an appropriate amount.
