COMPLAINT

The Plaintiff, Complaining of Defendants herein, would respectfully show unto this Court as follows:

1. Plaintiff is a citizen and resident of Richland County, South Carolina.

2. Upon information and belief, Defendant Wilson & Associates, Inc. is a South Carolina corporation now or formerly doing business in Richland County, South Carolina.

3. This action is brought to quiet title in the Plaintiff in a small triangular portion of Lot 40, Block R-2, Friarsgate B, Section 5E-1, TMS# 03904-09-45, locatred in the Friarsgate subdivision in Richland County, South Carolina. The subject tract is a portion of the property located at 306 Wharfsdale Rd., Irmo, South Carolina.

4. On July 21, 1981, Friarsgate, Inc. sold Lots 39 and 40 to Defendant Wilson & Associates, Inc. by deeds recorded at Book 582, pages 570 and 572. Defendant Wilson & Associates, Inc. deed out the major portion of Lot 40 and a minor portion of Lot 39 on November 17, 1981, by deed recorded at Book 593, page 730. Defendant Wison & Associates, Inc. deeded out the major protion of Lot 39 on December 29, 1981, by deed recorded at Book 597, page 190.

5. The Subject tract of land, the minor portion of Lot 40, was subsequently included in the property description in the shain of title to Plaintiff, although there is no deed of record from the tract's owner, Defendant Wilson & Associates, Inc. Plaintiff was conveyed his interest in the subject property and surrounding property on June 30, 1987, by deed recorded at Book 847, Page 983.

6. Plaintiff is infomed and believes legal title to the subject minor portion of Lot 40 remains with Defendant Wilson & Associates, Inc.

7. Plaintiff has used the subject property as his own since 1987 and has had title work performed in the past on three occasions which did not uncover the title defect.

8. Plaintiff and his agents and attorneys have attempted to contact Wilson & Associates, Inc. to have a corrective deed or quit-claim deed for the subject property executed in favor of Plaintiff. Wilson and Associates, Inc. has not been located, to date after numerous efforts and attempts.

9. Plaintiff is informed and believes he is entitled to an Order of this Court quieting title in the subject property in him and deeding the subject property to him.

10. Plaintiff is informed and believes he is entitled to an Order of this Court allowing the Defendants in this matter to be served with the Summons and Complaint by publication.

WHEREFORE, Plaintiff prays for an Order of this Court quieting title in the subject property in him and deeding the subject to him; for an Order of this Court quieting title in the subject property in him and deeding the subject property to him; for an Order of this Court allowing the Defendants in this matter to be served with the Summons and Complaint by publication; and for such other and further relief as this Court may deem just and proper.

Plaintiff brings this action pursuant to the provisions of the South Carolina Uniform Declaratory Judgment Act, Section 15-53-10, Code of Laws of South Carolina (1976. as amended) for the purpose of obtaining a decree adjudging that Plaintiff is seized in fee simple of a good and marketable title to the real estate hereinbelow described, and that no Defendants have any interest or estate in or lien upon the said real estate.

PETITION FOR ORDER APPOINTING GUARDIAN AD LITEM NISI AND FOR ORDER OF PUBLICATION

TO THE CLERK OF COURT FOR RICHLAND COUNTY, SOUTH CAROLINA:

Plaintiff alleges:

1. That he is the Plaintiff in the above entitled action; that an action has been commenced and is now pending in said Court to Quiet Title to the real estate described in thy Complaint, that the Plaintiff is informed and believes that there may be certain parties unknown to him who might have, or claim to have, some interest in or claim to said real estate; that after reasonable and diligent search, he has been unable to determine their names or to ascertain their whereabouts; that he,

therefore, made John Doe and Richard Roe, the same being fictitious names used as the true names of such persons as are unknown to the Plaintiff, party Defendants, as representatives of all unknown persons claiming any right, title, interest in, estate, or lien upon the real estate involved in this action in that some of the unknown Defendants, if any, are or may be unknown adults, minors or persons under other legal disability.

2. That Joseph N. Connell, Esquire, is a suitable and proper person to be appointed Guardian Ad Litem NISI for said unknown party Defendants who are unknown adults, resident or non- resident, known collectively as "John Doe," and that he is in no way connected in business with Plaintiff or his counsel and has no interest adverse to the interests of such unknown adults.

Furthermore, Plaintiff represents and alleges, through counsel, that Joseph N. Connell consents to the appointment and confirms that he has no interests adverse to the interests of said unknown adults, known collectively as John Doe, and that he is not connected in business with the adverse parties or with their counsel.

3. That David W. Farrell, Esquire, is a suitable and proper person to be appointed Guardian Ad Liteni NISI for said unknown party Defendants who are unknown and/or unborn infants or persons under legal disability, if any, being a class designated collectively as "Richard Roe." and that lie is in no way connected in business with Plaintiff or his counsel and has no interests adverse to the interests ofsuch infants or persons under other legal disability.

Furthermore, Plaintiff represents and alleges, through counsel, that David W. Farrell consents to the appointment and confirms that he has no interests adverse to the interests of said unknown infants and/or other persons under legal disability, if any, known collectively as Richard Roe. and thai he is not connected in business with the adverse parties or with their counsel.

4. WHEREFORE, your Petitioner prays that Joseph N. Connell be appointed Guardian Ad Litcm NISI for said unknown adult Defendants, if any, known as John Doe, and that David W. Farrell be appointed Guardian Ad Litem NISI for minor Defendants and Defendants under legal disability, if any, known collectively as Richard Roe.
