NOTICE OF UNCLAIMED VEHICLES/PUBLIC SALE

The following vehicles were Customer ordered tows and no one has claimed these vehicles as of 03/06/06. There is a lien on these vehicles for towing and storage charges and any additional storage or costs from the date of this notice. After fifteen (15) days from the date of this notice, Columbia Paint and Automotive at 844 Pepper Street, Columbia, SC 29209 will apply to the Lykesland Magistrate to sell these vehicles at Public Auction. If sold at Public Auction the successful bidder will get a title free and clear of any liens and encumbrances under section 56-5-5640. In accordance with the National Environmental Policy Act, the Office of Justice Programs of the National Institute of Justice has found that an Environmental Impact Statement (EIS) is not required for the granting of funds for the Columbia Police Department Crime Scene Investigation Forensic Laboratory. Significant Impact

Pursuant to Council on Environmental Quality regulations (40CFR Part 1500 et seq.) implementing the procedural provisions of the National Environmental Policy Act (NEPA; 42 USC 4331 et seq.), the Office of Justice Programs of the National Institute of Justice gives notice that an Environmental Assessment (EA) has been prepared and that an Environmental Impact Statement (EIS) is not required for the granting of funds for the Columbia Police Department Crime Scene Investigation Forensic Laboratory at Columbia, South Carolina.

Description of

Proposed Project

The Columbia, S.C. Police Department proposes to use federal funding for minor renovations within the existing space of the current laboratory to accommodate the purchase of equipment, chemicals, a laboratory information management system for evidence including computer software, lockers, a safe, and other equipment to secure and track evidence. Renovations will prevent contamination between work zones.

Purpose of and Need

for the Action

Timely processing of evidence from crime scenes is crucial to efficient administration of law by allowing crime scene evidence to be dealt with in a timely fashion for public safety and welfare

Project Location

The project will take place within the Columbia Police Department Building at 1 Justice Square, Columbia, South Carolina.

Alternatives Considered

The two alternatives considered by the police department were: 1) the No Action alternative; and 2) funding the laboratory improvements. A description of these alternatives follows:

Alternative 1: Under a No Action alternative, there would not be any additional funding for improvements to the laboratory, resulting in continued delays in evidence processing.

Alternative 2 (Preferred): The proposed action is to provide funds for the improvement of the Columbia Police Department Crime Scene Investigation Forensic Laboratory so that evidence can be processed swiftly and efficiently to meet the requirements of justice.

Effects of the

Preferred Alternative

The proposed action would improve the efficiency of evidence processing and thereby help to protect the public.

Findings

The U.S. Department of Justice, National Institute of Justice has determined that there would be no significant environmental impacts to the natural and human environment (air quality, water resources, topography, geology, soils, solid waste management, land use, transportation, the natural environment, endangered species, the human population, historic preservation, construction, energy) or to state environmental laws from funding the laboratory. There are no known significant cumulative impacts and there are no known significant unavoidable impacts. For these reasons, no EIS needs to be prepared.

4. Stephen Weston is the grandson of Jessie James Fuller and Rosa Bell Fuller and currently resides at the subject property and as such is named as Other Condemnee in this action.

5. Any unknown persons who may be heirs and entitled to claim through Jessie James Fuller and/or Rosa Bell Fuller are named in this action as Other Condemnees.

6. All unknown persons claiming any right, title, interest in or lien upon the real property described herein are named in this action as Other Condemnees.

7. All other unknown entities or adults designated as John Doe in this action are named as Other Condemnees.

8. Any unknown infants or persons in military service designated as Richard Roe in this action are named as Other Condemnees.

9. Richland County Treasurer is named as an Other Condemnee in this action by virtue of future real property taxes which are not yet due and payable or delinquent.

10. Exhibit A, attached hereto and incorporated herein by reference, is a description of the real property subject to this action and describes the interest sought by the Condemnor.

11. The Condemnor is vested with the power of aminent domain pursuant to 5- 7-50, Code of Laws of South Carolina, 1976, as amended.

12. The property sought herein is to be acquired for public purposes, more particularly for the Busby Street Redevelopment Project more specifically known as the Empowerment Zone Resource Training Center.

13. This action is brought pursuant to 28-2-240, Code of Laws of South Carolina, 1976, as amended.

14. The Condemnor has complied with the requirements setforth in 28-2-70(a), Code of Laws of South Carolina, 1976, as amended, by having the subject property appraised and certifies to the Court that a negotiated resolution has been attempted prior to the commencement of this action but an appointment of a guardian ad litem will be necessary.

15. Project plans may be inspected at the office of the City Attorney located at 1401 Main Street, 10th Floor, Columbia, South Carolina 29201, from 8:30 a.m. to 5:00 p.m., Monday through Friday.

11. THE CONDEMNOR HAS DETERMINED JUST COMPENSATION FOR THE PROPERTY AND RIGHTS TO BE ACQUIRED HEREUNDER TO BE THE SUM OF FIFTEEN THOUSAND AND 00/100 ($15,000.00) DOLLARS.

12. Since the Landowners are deceased, their estates have not been probated and title has not been transferred, the Condemnor is filing this Condemnation Notice with the Clerk of Court of the county where the property is situated and depositing the tender amount with the Clerk. The Condemnor shall give the Other Condemnees notice that it has filed the Notice of Condemnation (for unknown parties, service by publication) and may then proceed to take possession of the property interests and exorcise the rights described in this Condemnation Notice. Should the Condemnor elect to exercise its right TO take possession, it shall not do so until a guardian ad litem has been appointed for the unknown parties prior to taking possession and the guardian(s) will be notified of Condemnor's election to take possession prior to any taking of possession.

13. AN ACTION CHALLENGING THE CONDEMNOR'S RIGHT TO ACQUIRE THE PROPERTY AND RIGHTS DESCRIBED HEREIN MUST BE COMMENCED IN A SEPARATE PROCEEDING IN THE COURT OF COMMON PLEAS WITHIN THIRTY (30) DAYS OF THE SERVICE OF THIS CONDEMNATION NOTICE, OR THE LANDOWNER WILL BE CONSIDERED TO HAVE WAIVED THE CHALLENGE.

CONDEMNATION NOTICE AND FILING OF TENDER OF PAYMENT

(Jury Trial Demanded)

TO THE LANDOWNERS AND OTHER CONDEMNEES NAMED ABOVE:

Pursuant to the South Carolina Eminent Domain Procedure Act, 28-2-10, et. seq., Code of Laws of South Carolina, 1976, as amended, you are hereby notified as follows:

1. The City of Columbia, a municipal corporation, is the Condemnor herein and seeks to acquire the property interest described herein for public purposes.

2. Pam Robinson Pou and Valentine Timothy Robinson, Jr. (deceased) are the owners of the real property described in Exhibit B by virtue of that certain deed of Mary C. Robinson recorded April 29, 1987 in the Richland County Register of Deeds in Record Book D838 at page 974 (TMS Nos. 11607-08-05).

3. Valentine Timothy Robinsor, Jr. died on April 24, 2005 and his estate has not been probated.

4. He is survived by heirs-at-law which are identified in his obituary which is attached as Exhibit A.

5. The individuals listed in the caption as Other Condemnees are designated as such because they may have an interest or claim in the subject property through Valentine Timothy Robinson, Jr.

6. Any unknown condemnees who might be under a disability are designated as John Doe.

7. Any unknown infants or those who might be in the armed forces of the United States of America and entitled to protection under the Soldier's

and Sailor s Relief Act of 1940, as amended, are designated as Richard Roe.

8. Richland County Treasurer is named as an Other Condemnee in this action by virtue of future real property taxes which are not yet due and payable or delinquent.

9. Exhibit B, attached hereto and incorporated herein by reference, is a description of the real property subject to this action and describes the interest sought by the Condemnor.

10. The Condemnor is vested with the power of eminent domain pursuant to 5- 7-50, Code of Laws of South Carolina, 1976, as amended.

11. The property sought herein is to be acquired for public purposes, more particularly for the Busby Street Redevelopment Project more specifically known as the Empowerment Zone Resource Training Center.

12. This action is brought pursuant to 28-2-240, Code of Laws of South Carolina, 1976, as amended.

13. The Condemnor has complied with the requirements set forth in 28-2-70(a), Code of Laws of South Carolina (1976), as amended, by having the subject property appraised and certifies to the Court that a negotiated resolution has been attempted prior to the commencement of this action.

14. Project plans may be inspected at the office of the City Attorney located at 1401 Main Street, 10th Floor, Columbia, South Carolina 29201, from 8:30 a.m. to 5:00

p.m., Monday through Friday.

15. THE CONDEMNOR HAS DETERMINED JUST COMPENSATION FOR THE

PROPERTY AND RIGHTS TO BE ACQUIRED HEREUNDER TO BE THE SUM OF ONE

HUNDRED SIXTY FIVE THOUSAND AND 00/100 ($165,000.00) DOLLARS.

14. The Condemnor is filing this Condemnation Notice with the Clerk of Court in the county where the property is situated and is depositing the tender amount with the Clerk. The Condemnor shall not take possession until a guardian ad litem has been appointed for any unknown condemnees and prior notice of taking possession is provided to the guardian ad litem.

15. AN ACTION CHALLENGING THE CONDEMNOR'S RIGHT TO ACQUIRE THE PROPERTY AND RIGHTS DESCRIBED HEREIN MUST BE COMMENCED IN A SEPARATE PROCEEDING IN THE COURT OF COMMON PLEAS WITHIN THIRTY (30) DAYS OF THE SERVICE OF THIS CONDEMNATION NOTICE, OR THE LANDOWNER WILL BE CONSIDERED TO HAVE WAIVED THE CHALLENGE.

16. THE CONDEMNOR HAS ELECTED NOT TO UTILIZE THE APPRAISAL PANEL PROCEDURE AND DEMANDS A TRIAL BY JURY. The case may not be called for trial before sixty (60) days after the service of that notice, but it may thereafter be given priority for trial over other civil cases. The Clerk of Court shall give the parties written notice by mail of the call of the case for trial.
