If the plaintiff is the successful bidder at the sale, the amount due on its mortgage may be used as the equivalent of cash. Should the person making the highest bid at the sale fail to comply with the terms of the bid by depositing the said five percent (5%) in cash, then the premises shall be resold at such bidder's risk on the same sales date, or some subsequent date, as the selling officer may find convenient and advantageous. Should the last and highest bidder fail to comply with the terms of the bid within ten (10) days of the final acceptance of the bid, the entire deposit shall be forfeited, and the selling officer shall readvertise and resell the property on the same terms and at the bidder's risk on a subsequent sales day. Under 28 U.S.C. § 566, it is the duty of the United States Marshal to enforce the decree of the United States District Court and under § 564, the Marshal is authorized to exercise the same powers of the Sheriff in conducting the sale. In the matter of the Parenthood of Alexander Lugo, a Minor
COMES NOW Petitioner; SUSAN LOPEZ, mother of ALEXANDER LUGO, by and through her attorney, Carlotta McInteer, and asks the Court tor termination of the parental rights of the father of her son, JORGE LUGOCANCEL. In support of this petition, she states:
1. Petitioner and JORGE LUGOCANCEL were married in January 1993 in Peñasco, New Mexico, and were divorced in San Antonio Texas in 1996, case number 32A-5-16. There was no mention of the child in the divorce. There was domestic violence involved and Petitioner needed to escape from Texas as quickly as possible to avoid harm to the child and to herself.
ALEXANDER LUGO was born March 24, 1996 in Albuquerque, New Mexico- and is now nine years old.
2. There has been no contact with the father of the child since the child's birth. The father has provided no support for the child.
3. The father, JORGE LUGOCANCEL, was from Puerto Rico and was in the Army at the time the parents divorced. The mother does not know where he might live now, and has had no contact with him or with any family of his since the divorce. He may no longer be in the
service.
4. Petitioner would like her status formalized as the only parent of Alexander Lugo, so
that, for example, she can get a passport for him. Alexander has lived with his mother, a single woman, in Peñasco since December of 1995.
WHEREFORE, Petitioner asks the Court for:
1. An order terminating the parental rights of JORGE LUGOCANCEL, declaring
Petitioner to be the full Guardian and Custodian of the child, ALEXANDER LUGO.
2. For such other relief as the Court may find just and appropriate.
