That Plaintiff does have a special property interest therein by reason of breach by the Defendant Clayton Crisp of the terms of that certain Loanliner Advance Request Voucher and Security Agreement dated December 24, 1997, which document conveyed the chattel to the Plaintiff. The Defendant, Lonnie Roberts Auto Service, Inc., is believed to have possession of the chattel. The actual value of the said property is Nine Thousand Seven Hundred Fifty and no/l00ths ($9,750.00) Dollars.

That deponent wishes to have the secured chattel immediately recovered and fully reserve the right of the Defendants to a Pre-seizure Hearing before the secured chattel, as aforementioned, can be disposed of by the Plaintiff.

Clayton Crisp and Lonnie Roberts Auto Service, Inc.,

The Plaintiff herein, complaining of the Defendants alleges as follows:

1. That it is banking institution organized and existing under the laws of the State of

South Carolina;

2. That, on information and belief, the Defendant Clayton Crisp is a resident of the

County of Richland, State of South Carolina.

3. That this is an action for recovery of an indebtedness due unto the Plaintiff arising out of a Loanliner Advance Request Voucher and Security Agreement to the Defendant Clayton Crisp.

4. Jurisdiction vests in this Court pursuant to Article V of the South Carolina Constitution.

5. That heretofore, on or about December 24, 1997, the Defendant Clayton Crisp made and delivered to Plaintiff a certain Loanliner Advance Request Voucher and Security Agreement, a copy of which is attached hereto as Exhibit "A", in writing, to better secure payment of a Note owing to Plaintiff; and that the Defendant Clayton Crisp is in default in the payment of said Loanliner Advance Request Voucher and Security Agreement and is now indebted to the Plaintiff in the sum of five Thousand Eight Hundred Seventy-Four and 63/l00ths ($5,874.63) Dollars in addition to interest at the lawful rate, Eight Hundred Eighty-One and 20/l00ths ($881.20) Dollars as reasonable attorneys fees, and the costs of this action; and the terms of the Loanliner Advance Request Voucher and Security Agreement have not been waived.

6. That the Notice of Consumer’s Right to Cure, as contemplated under S.C. Code Sections 37-5-111, was sent as applicable.

7. That the Defendant Lonnie Roberts Auto Service, Inc., has possession of the chattel and may have a vested interest in the chattel. WHEREFORE, the Plaintiff prays Judgment against the Defendants as follows:

AS TO THE DEFENDANT CLAYTON CRISP:

(a) for the immediate and permanent possession of those chattels more particularly described in Exhibit "A", attached hereto and incorporated herein by reference;

(b) or, if possession and liquidation of the asset has lesser value than the balance, due and owing, then for a Deficiency Judgment in that balance amount;

(c) or, if possession cannot be had, for the sum of Five Thousand Eight Hundred Seventy-Four and 63/l00ths ($5,874.63) Dollars;

(d) for interest and Eight Hundred Eighty-One and 20/100ths ($881.20) Dollars as reasonable attorneys fees in addition to costs;

(e) and for such other and further relief as may be just and equitable.

AS TO THE DEFENDANT LONNIE ROBERTS AUTO SERVICE, INC.
