NOTICE OF UNCLAIMED VEHICLES/
PUBLIC SALE
The following vehicles were ordered towed by Law Enforcement and no one has claimed these vehicles as of February 18, 2005. There is a lien on each vehicle for towing and storage charges and any additional storage or costs from the date of this notice. After thirty (30) days from the date of this notice Suddeth Towing at 1512 Heidt St., Columbia, SC 29204 will apply to the
Waverly Magistrate to sell these vehicles at Public Auction. If sold at Public Auction the successful bidder will get a title free and clear of any liens and encumbrances under section 56-5-5640. All parties that have any interest in the following vehicles have until the day of the auction to reclaim the vehicle upon payment of all charges.

HAVING READ and filed the petition of Holly Saleeby Atkins, attorney for the Claimant it appears that this is an action for injuries sustained in a worker’s compensation injury, which occurred on April 27, 2004, while working for the above employer, in which the Claimant sustained injuries to multiple body parts including his right arm, both knees and back, and requests treatment for his injuries.
The Claimant also requests temporary total disability benefits from June 19, 2004 to the present, further it appears that defendant Rocco J. Nicosia d/b/a Adirondack Acoustical, Inc. cannot, after due diligence, be located in the county and state. It is requested that the employer file a Form 51 with the South Carolina Worker’s Compensa-tion Commission in response to the Form 50.
IT IS ORDERED that the service in this matter be made on the employer by publishing a copy of the Order of Publication of Worker’s Compensation Claim in a newspaper of general circulation in Richland County, South Carolina, once weekly for three (3) consecutive weeks, and by forwarding a copy of the pleadings to the defendant at the last known address.

Under authority and direction of the DECREE OF FORECLOSURE AND SALE in the above action filed on January 13, 2005, I will offer for sale at public auction before the Courthouse door of the Richland County Courthouse, Columbia, South Carolina, Eleven O'Clock A.M., Thursday, March 17, 2005, the following described property:
All that certain piece, parcel or lot of land with all improvements thereon, situate, lying and being approximately 1.5 miles Southeast of Blythewood, County of Richland, State of South Carolina, and being shown and designated as Lot 2 on a plat of “Lots” surveyed for Statewide Homes Foundation, Inc. by Dewey H. Campbell, Jr., RLS, dated March 6, 1970 and recorded in the Office of the Clerk of Court for Richland County in Deed Book D-415 at Page 452. Said lot also being shown on an individual plat for Lot 2 for Statewide Homes Foundation, Inc. dated March 9, 1970, prepared by Dewey H. Campbell, Jr., RLS. Said lot having the following measurements and boundaries: South by an unnamed county road whereon it fronts and measures 107.00 feet; West by Lot 3 on said plat whereon it measures 279.10 feet; North by lands now or formerly of Statewide Homes Foundation, Inc. whereon it measures 107.10 feet; and on the East by Lot 1 of said plat whereon it measures 282.90 feet. All of which will more fully appear by reference to the aforementioned plat together with all and singular the rights, members and hereditaments and appurtances to the said premises belonging or in anywise incident or appertaining.

Being the identical property conveyed to Ezell Wright, Jr., a/k/a Ezell Wright, and Lizzie Wright by deed of the United States of America, acting through the Farmers Home Administration, dated October 8, 1987, and recorded October 16, 1987, in the Office of the Clerk of Court/RMC for Richland County, South Carolina, in Deed Book D-862 at Page 507. Ezell Wright, Jr., a/k/a Ezell Wright, died March 18, 1992 and Lizzie Wright died February 24, 1998. Property is vested in their heirs.
The above property will be sold subject to ad valorem taxes, the purchaser of said real estate to pay extra for deed and revenue stamps. Plaintiff not having affirmatively sought a deficiency judgment, the bidding will not stay open for the customary thirty (30) days following the sale. Sale shall require the highest bidder, other than the plaintiff, to make a cash deposit of five percent (5%) of the bid as earnest money and as evidence of good faith. If the plaintiff is the successful bidder at the sale, the amount due on its mortgage may be used as the equivalent of cash. Should the person making the highest bid at the sale fail to comply with the terms of the bid by depositing the said five percent (5%) in cash, then the premises shall be resold at such bidder's risk on the same sales date, or some subsequent date, as the selling officer may find convenient and advantageous. Should the last and highest bidder fail to comply with the terms of the bid within ten (10) days of the final acceptance of the bid, the entire deposit shall be forfeited, and the selling officer shall readvertise and resell the property on the same terms and at the bidder's risk on a subsequent sales day. Under 28 U.S.C. § 566, it is the duty of the United States Marshal to enforce the decree of the United States District Court and under § 564, the Marshal is authorized to exercise the same powers of the Sheriff in conducting the sale. It is in the interest of justice that the sale be conducted to yield the best price through free, fair, and competitive bidding. Any act that appears to prevent a free, fair, and open sale or to suppress the bidding or otherwise adversely affects the sale, will not be allowed. If such an act occurs, then the sale will be halted. Further, the individual or individuals who perform any act which appears to contribute to the sale being halted or otherwise adversely affected, may be charged with contempt of court, to be sanctioned accordingly, including but not limited to paying for the costs and expenses of the scheduled sale.

1. Richland County is the Condemnor herein for public purposes, namely for the construction, improvement and maintenance of Sease Road,
located in Richland County, South Carolina.
2. The following is named as having upon information and
belief an interest in the
property:
a. Otis Metz, Jr., is named as a Landowner in this action based upon that certain deed filed in Deed Book 816, Page 2842, dated June 10, 2003, recorded July 7, 2003, in the Office of the Register of Deeds for Richland County, South Carolina.
3. Exhibit A, attached hereto and incorporated herein by reference is a description of the real property subject to this action and Exhibit B, attached hereto and incorporated herein by reference is a description of the interest sought by the Condemnor.
4. Richland County is vested with the power of eminent domain pursuant to Section 4-9-30 of the Code of Laws of South Carolina, 1976, as amended.
5. The property sought herein is to be acquired for public purposes, more particularly for construction, improvement and maintenance of Sease Road.
6. This action is brought pursuant to Section 28-2-240, Code of Laws of South Carolina, 1976, as amended.
7. Richland County has complied with the requirements set forth in section 28-2-70(A), Code of Laws of South Carolina, 1976, as amended, by having the subject property appraised and certifies to the Court that a negotiated resolution has been attempted prior to the commencement of this
action.
8. Project plans may be inspected at the office of the Richland County Department of Public Works & Utilities - 400 Powell Road, Columbia, South Carolina, 29203.
9. THE CONDEMNOR HAS DETERMINED JUST COMPENSATION FOR THE PROPERTY AND RIGHTS TO BE ACQUIRED HEREUNDER TO BE THE SUM OF ZERO ($0.00) DOLLARS AND HEREBY TENDERS PAYMENT THEREOF TO THE LANDOWNER.
10. Payment of this amount will be made to the Landowner if within thirty (30) days of this Condemna-tion Notice, the Landowner in writing requests payment, and agrees to execute any instruments necessary to convey to the Condemnor the property interests and rights described hereinabove. The request and agreement must by sent by first class, certified mail with return receipt requested or delivered in person to the Condemnor at the Richland County Attorney's Office, Post Office Box 192, 2020 Hampton Street, Columbia, South Carolina 29201. If no request and agreement is received by the Condemnor within the thirty-day (30) period, the tender is considered rejected.
11. The Condemnor has the right to file this Condemna-tion Notice with the Clerk of Court of the County where the property is situated and deposit the tender amount with the Clerk. The Condemnor shall give the Landowner notice that it has done so and may then proceed to take possession of the property interests and exercise the rights described in this Condemnation Notice. Should the Condemnor elect to exercise its right to take possession, it shall notify the Condemnee by separate Notice prior to taking possession.
12. AN ACTION CHALLENGING THE CONDEMNOR'S RIGHT TO ACQUIRE THE PROPERTY AND RIGHTS DESCRIBED HEREIN MUST BE COMMENCED IN A SEPARATE PROCEEDING IN THE COURT OF COMMON PLEAS WITHIN THIRTY DAYS OF THIS CONDEMNATION NOTICE, OR THE LANDOWNER(S) WILL BE CONSIDERED TO HAVE WAIVED THE CHALLENGE.
13. THE CONDEMNOR HAS ELECTED NOT TO UTILIZE THE APPRAISAL PANEL PROCEDURE. Therefore, if the tender herein is rejected, the Condemnor shall notify the Clerk of Court and shall demand a trial to determine the amount of just compensation to be paid. A copy of that notice must be served on the Landowner. That notice shall state whether the Condemnor demands a trial by jury or by the court without a jury. The Landowner has the right to demand a trial by jury. The case may not be called for trial before sixty (60) days after the service of that notice, but it may thereafter be given priority for trial over other civil cases. The Clerk of Court shall give the Landowner written notice by mail of the call of the case for trial.
14. THEREFORE, IF THE TENDER HEREIN IS REJECTED, THE LANDOWNER(S) ARE ADVISED TO OBTAIN LEGAL COUNSEL AT ONCE, IF NOT ALREADY OBTAINED.
15. In the event the Landowner accepts the amount tendered in this Notice, the attached Request for Payment and Agreement form should be signed and returned to the Condemnor within (30) days of your receipt of this Notice.

NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending in this court upon Complaint of the above-named Plaintiff against the above-named Defendants for foreclosure of a certain mortgage of real estate given by Bert Furlow to 1st American Home Mortgage, Inc. in the amount of $188,950.00, dated June 22, 2001, and recorded in the Office of the Register of Deeds for Richland County in Book 542 at Page 472 on July 12, 2001.
The premises covered and affected by the said mortgage as by the foreclosure thereof, were at the time of the making thereof, and at the time of the filing of this Notice, described as follows:
All that certain piece, parcel or lot of land, situate, lying and being in the County of Richland, State of South Carolina, being shown and delineated as Lot 47 on a plat of Ashley Place Phase Two prepared by Civil Engineering of Columbia, dated February 12, 1999 and recorded in the Office of the Register of Deeds for Richland County in Book 299, Page 721.
