NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending in this court upon Complaint of the above-named Plaintiff against the above-named Defendant for foreclosure of a certain mortgage of real estate given by Dennis Brown to Bank One, N.A. in the amount of Ninety Thousand Two Hundred Fifty And 00/100 ($90,250.00) Dollars, dated September 28, 2001, and recorded in the Office of the RMC for Richland County in Book 575 Page 1451.

The premises covered and affected by the said mortgage as by the foreclosure thereof, were, at the time of the making thereof, and at the time of the filing of this Notice, described as follows:

COMPLAINT 

The Plaintiffs, complaining unto the Defendants, would 

respectfully show unto this Honorable Court as follows:

FIRST: That the Plaintiffs are residents of the County of Charleston, State of South Carolina and have been such for more than six (6) months prior to the filing of this action.    

SECOND: That the Plaintiffs are lawfully married and have been married since December 28, 1996.                   

THIRD: That the Plaintiffs are informed and believe that the Defendant, Jacqueline L. Mitchell, formerly known as Jacqueline L. Holt, is a resident of the County of  Lexington, State of South Carolina.

 

FOURTH: That the Plaintiffs are informed and believe that the Defendant, Michael Ray Holt, was last known to have resided in the County of Richland, State of South Carolina.   

FIFTH: That the Defendant,  Alexander M. Gilchrist, had previously been a resident of the County of Richland, State of South Carolina, but is now presently residing in the County of Charleston, State of South Carolina.

SIXTH: That the Plaintiffs are informed and believed that the Defendant, Jacqueline L. Mitchell and 

Michael Ray Holt, are the natural parents of the minor child, Elizabeth Ann Holt, who was born on February 5, 1990.

SEVENTH: That the Defendant, Alexander M. 

Gilchrist, had custody of the Defendant, Michael Ray Holt, during said Defendant’s minority.

EIGHTH: That the Plaintiffs are informed and believe that the Defendants, Jacqueline L. Mitchell and ,Michael Ray Holt, were married at the time the minor child, Elizabeth Ann Holt, was born.

NINTH: That the said Defendants, Jacqueline L. Mitchell and Michael, were living with the Defendant, 

Alexander M. Gilchrist, when the minor child, Elizabeth Ann Holt, was born.

TENTH: That the Plaintiffs are informed and believe that the Defendants, Jacqueline L. Mitchell and Michael Ray Holt, subsequently divorced, and that the Defendant, Jacqueline L. Mitchell has remarried

ELEVENTH: That the Plaintiffs are informed and believe that the minor child, Elizabeth Ann Holt, continues to live with the Defendant, Alexander M. Gilchrist, and is current residing here in Charleston County.

TWELFTH: That the Plaintiffs are informed and believe that on February 9, 1994, the Defendants, Alexander M.Gilchrist and Jacqueline L. Mitchell, entered into a Custody and Support Agreement wherein the Defendant, Alexander M. Gilchrist, was granted custody of the minor child, Elizabeth Ann Holt, by the  Defendant, Jacqueline L. Mitchell.

THIRTEENTH: That the Plaintiffs are informed and believe that the said Agreement was subsequently approved by the Family Court for the Eleventh Judicial Circuit in an Order dated October 10, 1994 in Case No. 96-DR-32-0522.

FOURTEENTH: That the Defendant, Alexander M. Gilchrist, has had custody of the minor child since that time.

FIFTEENTH: That the Plaintiffs are informed and believe that the Defendant, Jacqueline L. Mitchell, has had sporadic contact with the minor child, Elizabeth Ann Holt, since 1994. 

SIXTEENTH: That the Plaintiffs are informed and believe that the Defendant, Michael Ray Holt, has had almost no contact with the minor child since 1994, and has not provided any support for the minor child since 1994.

SEVENTEENTH: That the Defendant, Alexander M. Gilchrist, is the Uncle of the Plaintiff, John E. Gilchrist, Jr.

EIGHTEENTH: That the Plaintiffs are informed and 

believe that the Defendant, Alexander M. Gilchrist, has been diagnosed with cancer.

NINETEENTH: That the Plaintiffs are informed and believe that it would be in the best interest of the minor child, Elizabeth Ann Holt, for custody of said child to be granted to the 

Plaintiffs.

TWENTIETH: That the Plaintiffs are informed and believe that the Defendant, Alexander M. Gilchrist, is in agreement with the Plaintiffs’ seeking custody of the minor children, Elizabeth Ann Holt.

TWENTY-FIRST:  That while the Plaintiffs are in a 

position to assume the financial responsibility for the welfare of the minor child, Elizabeth Ann Holt, the Plaintiffs are also informed and believe that the Defendant, Alexander M. Gilchrist, has taken steps to 

provide for the financial well-being of the said minor child through various estate planning measures.

TWENTY-SECOND: That although the Defendant, Jacqueline L. Mitchell, has had minimal contact with the minor child, Elizabeth Ann Holt, over the last several years, the Plaintiffs believe that the Defendant, 

Jacqueline L. Mitchell, should be  granted reasonable visitation with the minor child on such terms as agreed upon by the parties.

TWENTY-THIRD: That the Plaintiffs are informed and  believe that should legal custody of the minor child be granted to the Plaintiffs, that the Defendant, Alexander M. Gilchrist, should have the right to have the minor child continue to reside with him as long as the said Defendant desires.

                          WHEREFORE, the Plaintiffs would pray unto this Honorable Court as follows:                      

ONE: That the Court issue its Order granting physical 

and legal custody of the minor child, Elizabeth Ann Holt, to the Plaintiffs.

TWO:  That the Defendant, Alexander M. Gilchrist, be 

granted the right to have the minor child reside with him as long as the said Defendant desires.

THREE: For an Order awarding the Defendant, Jacqueline L. Mitchell, reasonable visitation with the minor child, Elizabeth Ann 

Holt, as determined by the Plaintiffs.

FOUR: For such other and further relief as this Court may deem just and proper.

NOTICE IS HEREBY GIVEN THAT an action has been or will be commenced and is now or will be pending in this Court upon complaint of the above-named Plaintiff against the above-named Defendant(s) for the foreclosure of a certain mortgage of real estate given by Fred Wright, Jr. and Hazel Wright to Great Eastern Financial Services, Inc. dated December 29, 1995, and recorded in the public records of Richland County on January 16, 1996, in Book M1931 at Page 882. The Mortgage was thereafter assigned to Green Tree Financial Servicing Corporation by assignment dated August 24, 1995, and recorded October 30, 1996, in Book M2040 at Page 195.

The premises covered and affected by the Plaintiff's mortgage and the foreclosure thereof, were, at the time of the making thereof, and at the time of the filing of this notice, described as follows:

All that certain piece, parcel or lot of land with all improvements thereon, situate, lying and being near the City of Columbia, County of Richland, State of South Carolina, being designated as Lot 6 on a plat of First American Corporation dated June 27, 1962, by McMillan Engineering Company recorded in Plat Book T at Page 83, in the Office of the Clerk of Court for Richland County.

This being the same property conveyed to Fred Wright, Jr. by deed of First American Corp. dated March 13, 1964, and recorded March 31, 1964, in Book 382 at Page 328. Subsequently, Fred Wright, Jr. conveyed a one-half (1/2) undivided interest in the subject property to Hazel Wright by deed dated June 2, 1993, and recorded June 4, 1993, in Book D1144 at Page 499.

Fred Wright, Jr. died testate on August 20, 2001, leaving the subject property to his devisee, Hazel S. Wright, as is more fully preserved in the Probate records for Richland County, in Case No. 03-ES-40-413. Hazel S. Wright died testate on February 25, 2003, leaving the subject property to her devisees, namely, Becky Wright Alexander, Fred Wright III, and Annette H. Wright, as is more fully preserved in the Probate records for Richland County, in Case No. 03-ES-40-414.
